The present petition has been filed under Section 482 of the Code of Criminal Procedure for getting the investigation of the FIR No.18, dated 08.01.2020, registered under Sections 420 and 406 IPC and Section 24 of the Immigration Act, 1983 at Police Station Karnal Sadar, District Karnal conducted by some higher and impartial officer.

Learned counsel contends that the petitioner has been cheated by respondent Nos.6 to 8 by promising to send him abroad, for which they had taken a huge amount from him and neither the same has been returned nor he has been sent abroad. Despite registration of the FIR against them, the police is not taking any action against them.

Learned State counsel submits that investigation of the case is going on as per law and he refers to paras 4 & 5 of the reply dated 02.03.2022 which reads thus:

"4. That besides the present case bearing FIR No.0018, dated 08.01.2020, under Section 406, 420, 270, 384 IPC and Section 24 Immigration Act of Police Station Sadar, Karnal one other case bearing FIR No.420, dated 17.12.2019, under Section 406, 420 of IPC has also been registered against the respondent No.6 namely Ved Pal, in which also letter for opening of Regular Look Out Ankur Goyal 2023.08.17 09:14 I attest to the accuracy and integrity of this order/judgment

CRM-M-27043-2021 2023:PHHC:101855 --2-- Circular against respondent No. 6 was got issued by the Director General of Police, Haryana to the Deputy Director Bureau of Immigration (BOI), East Block, R.K. Puram, New Delhi vide Endst. No.3731/CR-4 dated 25.02.2021.

5. That efforts were made to apprehend and arrest the accused Parveen Balan after tracing his correct place of residence. In this regard a team was constituted under the supervision of Station House Officer Police Station Sadar, Karnal and efforts are being made to arrest the accused Parveen Balan and to produce him before the Hon'ble Court."

In view of the above, no further orders are required to be passed in the matter and the present petition is disposed of as having been rendered infructuous.
