A.B.CHAUDHARI, J. (ORAL) Heard learned counsel for the rival parties.
The prayer in this petition is for transfer of the investigation of FIR No. 441 dated 10.11.2014 under Section 302/34 IPC registered at Police Station Farakpur, District Yamuna Nagar, to some independent agency.
Learned counsel for the State submits that charge sheet was already filed against the principal accused Assa Singh and in the investigation it was found that other accused persons proposed by the petitioner in the FIR, there was nothing found against them and thus, they were placed in column no.2 of the
CRM NO. M-4611 OF 2015 -2challan. According to him, now the trial has also commenced and out of 22 witnesses, 06 witnesses have been examined. Learned counsel for the petitioner fairly states that an application under Section 319 Cr.P.C was moved and the same was dismissed by the trial Court and the said order was affirmed by his Court also.
In that view of the matter, in my opinion, nothing further is to be done as towards the principal accused persons, the matter has become final and conclusive.
