Prayer in the instant petition filed under Section 528 of BNSS, is for issuance of direction to the Appellate Court, Hoshiarpur to conclude the proceedings in Criminal Appeal No. CRA-485/2025, CNRPBHO0100 89502025, arising from judgment of conviction dated 16.05.2019 passed by the ACJM, Hoshiarpur, in FIR No.20 dated 24.02.2018 under Section 8 & 9 of Punjab Good Conduct Prisoner (Temporary Release) Act, 1961, at Police Station Sadar, Hoshiarpur.

Learned counsel for the petitioner has submitted that the petitioner was convicted by the trial Court under Section 8 & 9 of Punjab Good Conduct Prisoner (Temporary Release) Act, 1961 to undergo rigorous imprisonment for a period of 01 year. Being aggrieved, the petitioner approached the learned Appellate Court. CRM-M-20131 of 2026 -2had filed an application under Section 430 of BNSS praying suspension of the sentence. He argued that the said application was filed on 07.11.2025 but the same has not been decided till date. At this juncture, learned counel for the petitioner submitted that he would be satisfied that if the said application of the petitioner or the appeal is decided by the Appellate Court, in a time bound manner.

In view of the limited prayer made by learned counsel for the petitioner, this Court is inclined to grant limited relief. Accordingly, the present petition is disposed of with a direction to the learned Appellate Court to make earnest endeavour to decide the appeal/application of the petitioner expeditiously, as per law.
