REKHA MITTAL J. (Oral) The petitioner has invoked Section 482 of the Code of Criminal Procedure (in short 'Cr.P.C.') for issuance of appropriate directions to respondents No.1 and 2 to protect life, liberty and property of the petitioner at the hands of respondents No.3 and 4 and their subordinate officials as he is being harassed and humiliated at the instance of respondent No.5 and her parental family. Counsel for the petitioner has submitted that there is marital disharmony between the petitioner and his wife Pooja Kaur - respondent No.5 and the petitioner has already filed a petition under Section 13 of the Hindu Marriage Act for a decree of divorce pending adjudication in the Court of Additional District Judge, Amritsar.

It is further submitted that despite their being no complaint much less a first information report submitted by Pooja Kaur or her parental family, the petitioner is being called time and again by respondents No.3 and 4 resulting in harassment. It is further submitted that petitioner would be Mohd. Yakub 2017.04.

CRM No.M-45682 of 2016 satisfied if a direction is issued to the Senior Superintendent of Police (Rural), Amritsar to look into grievance of the petitioner that he and his family is not unnecessarily harassed.

I have heard counsel for the petitioner and perused the paperbook.

Without meaning to express any opinion qua the correctness or otherwise of the allegations raised in the petition, the present petition stands disposed of with a direction to the Senior Superintendent of Police (Rural), Amritsar to look into conduct of respondents No.3 and 4 only to the extent as to why the petitioner and his family members are being called by respondents No.3 and 4 even in absence of any complaint by Pooja Kaur or her family members. However, nothing stated in this order shall be construed as a restraint against action, as per law, against the petitioner or his family members, if they have committed a cognizable offence.
