RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C., petitionerVikramjeet Singh @ Vicky, has prayed for grant of regular bail in case FIR No. 0149 dated 11.07.2018 registered under Section 21 of the NDPS Act and Sections 353, 186, 323, 506 read with Section 34 IPC at Police Station Chhehartta, District Amritsar.

According to the prosecution, petitioner was found involved in the instant case on the basis of disclosure statement of his co-accusedShashi Learned counsel for the petitioner inter alia contends that disclosure statement of a co-accused is a very weak type of evidence. Petitioner is in custody since 16.07.2018. Conclusion of trial may take a long time. No useful purpose would be served by detaining him in jail. CRM-M-45757-2018 -2More so, co-accused of the petitioner, namely; Shubham Mattu, Juna Devi @ Manju and Kushi, have already been enlarged on regular bail by this Court, vide orders dated 24.08.2018, 17.09.2018 and 27.09.2018 (Annexures P-3 to P-5), passed in CRM-M- Nos. 35803, 39352 and 41773-2018, respectively. Thus, treating the case of the petitioner on the same parity, he may be granted the concession of regular bail. On the other hand, learned State counsel vehemently opposed the above submission of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed.

Consequently, petitioner-Vikramjeet Singh @ Vikcy, is ordered to be released on bail pending trial, treating his case on the same parity as that of his co-accused, namely; Shubham Mattu, Juna Devi @ Manju and Kushi, on his furnishing adequate bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
