NARESH KUMAR SANGHI, J (Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Pawanjit Singh, son of Jagjit Singh, resident of Street No. 1, Shakti Nagar, Tehsil and District Barnala, who has been booked for having committed the offences punishable under Sections 323, 325 and 498-A, IPC, in a case arising out of FIR No. 15, dated 17.1.2015, registered at Police Station, City, Barnala.

CRM-M-4695-2015 Learned counsel for the State on instructions from Inspector Paramjeet Singh, Station House Officer, Police Station, City, Barnala, submits that the statement with regard to parallel inquiry during pendency of investigation of present case, was inadvertently suffered before this Court on the last date of hearing. In fact, an inquiry was going on in respect of an application presented by the petitioner for issuance of directions to his parents in-laws not to get the pregnancy of his wife terminated. He further submits that the petitioner has joined the investigation and his custodial interrogation is not required in the present case. I have heard learned counsel for the parties and with their able assistance gone through the material available on record.

Keeping in view totality of the facts and circumstances of the case, the present petition is allowed. The interim directions issued by this Court vide order dated 12.3.2015 are made absolute. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2), Cr.P.C.
