Prayer in the instant petition, filed under Section 482 of the Code of Criminal Procedure (Cr.P.C.), is for issuance of directions to the official respondents to ensure fair investigation of the case registered against certain police officials in connection with death of petitioner's father due to police torture, assault and humiliation, with further direction to protect life and liberty of the petitioner and his family members, who were under constant threat at the hands of respondents.

Notice of motion in this case was issued on 29.01.2018 by a Coordinate Bench of this Court. Replies were also filed on behalf of respondent State from time to time. From copy of order dated 27.08.2024 passed by learned Chief Judicial Magistrate, Tarn Taran, which has been produced by State Counsel, it is revealed that on 03.02.2023, cancellation MONIKA 2025.05.14 16:48 I attest to the accuracy and integrity of this document

CRM-M-44835-2017 report was submitted by the investigating agency in this case, but the petitioner (complainant) objected to the same, submitting before the Trial Court that he was not satisfied with the investigation. So, the said cancellation report was sent back by the Court for further investigation. Again, on 27.08.2024, cancellation report was submitted before the learned Trial Court in this case. The petitioner again stated that he was not satisfied with the investigation conducted in this case and did not agree with cancellation report. However, the cancellation report was admitted by the Court and he was directed to avail his remedy by way of filing Protest Petition.

In view of the aforesaid, it is clear that no further order is required to be passed in this case, when the cancellation report submitted by the investigating agency has already been accepted by the learned Trial Court vide order dated 27.08.2024. In these peculiar circumstances, the present petition has been rendered infructuous and is accordingly disposed of as such.
