Ms. Mahima Yashpal, D.A.G. Haryana *** Ritu Bahri, J. (Oral) This petition under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No.60 dated 07.02.2020, under Sections 420/467/468/471/120-B IPC, registered at Police Station DLF, Sector 29, Gurugram.

At the very outset, learned counsel for the petitioner has referred to order dated 20.07.2020 passed in CRM-M-17109-2020 and CRM-M-17451-2020 (P-2), wherein the co-accused Pawan and Dalip had been granted regular bail and in this order, reference has been made to order dated 12.06.2020 passed in CRM-M-13588-2020 granting regular bail to co-accused Sumit Kumar. Learned counsel for the petitioner submits that no recovery has been effected from the petitioner. Petitioner was working in the shop in the capacity of office boy.

A bare perusal of order dated 20.07.2020 shows that Pawan and GAURAV ARORA 2020.08.19 12:59 I attest to the accuracy and integrity of this document Chandigarh Dalip has been nominated on the disclosure statement of Chitranjan.

CRM No. M-22363 of 2020 -2Learned State counsel, on instructions, informs that challan has already been presented on 06.05.2020 but charges have not been framed. However, learned state counsel states that petitioner is a resident of Nepal and if he be allowed regular bail, he will flee to Nepal. Heard.

Keeping in view the period of incarceration of the petitioner and the fact that trial may still take some time for its conclusion, this court feels that there is no need to detain the petitioner any longer. Accordingly, this petition is allowed and petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Gurugram, subject to furnishing requisite bonds/surety bonds by a person who is a resident of India.
