 %& During the course of arguments, it has come to the notice of this Court that the records containing Staff Court of Inquiry conducted by the BSF authorities is completely non8speaking order without discussing the evidence and the reasons which has led to the conclusion by the authorities as to the death of Sunil Kumar. Mr. N.S. Shekhawat, Advocate representing the petitioner has prayed that the petitioner Ranbir Singh being father had applied RATTAN PAL SINGH 2016.02.24 11:34 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court



    earlier before the BSF for getting a copy of the Inquiry Report but the same has been declined.

Keeping in view the relationship of the deceased with the petitioner and that it is essential for him to know the causes leading to the death of his son, necessary directions are issued to respondents No.3 and 4 to provide complete copy of the Inquiry Report to the petitioner. Meanwhile records of the respondent BSF earlier submitted to this Court by their counsel are ordered to be returned. Faced with this situation, learned counsel for the petitioner on instructions from his client has made a statement before this Court withdrawing the present petition, however reserving rights of the petitioner to file a fresh one under Articles 226/227 of the Constitution of India.

Allowed to do so.

The petition stands dismissed as withdrawn with liberty aforesaid.
