ALKA SARIN, J.: (Oral) Heard through video conferencing.

The present petition has been filed under Article 226 of the Constitution of India for issuance of a direction to the respondents to make payment of Rs.12,85,000/- qua the works executed by the petitioner. It has been contended by the learned counsel for the petitioner that the petitioner has successfully completed works of operation and maintenance, but the payment of the bills is not being released. Both the final bills have been duly passed and it has been certified that the petitioner has executed the works satisfactorily as per the agreement. It is further contended that in this regard the petitioner has approached the respondents numerous times and has also given representations on a number of occasions. One such representation dated 22.04.2020 has been attached as Annexure P-3 to the petition.

CWP No.11510 of 2020 - 2 - On the asking of the Court, Ms. Ambika Bedi, Assistant Advocate General, Punjab has joined the session through video conferencing and accepts notice on behalf of the State of Punjab. She, on instructions, has stated that the representation of the petitioner is yet to be decided.

In view of the above, respondent No.4, i.e., Executive Engineer, Water Supply & Sanitation Division, Fazilka, is directed to consider and take an appropriate decision on the petitioner's representation (Annexure P-3) as per law. In the event respondent No.4 finds that the dues as claimed by the petitioner are lawful and payable, the same may be released at the earliest.

The petition stands disposed of accordingly.
