Petitioner-Meena has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in case FIR No.161 dated 02.07.2016, registered at Police Station Baroda, District Sonipat, under Sections 302, 201 and 34 of the Indian Penal Code.
Notice of motion was issued. Learned State counsel put in appearance on behalf of the respondent-State and contested this petition. I have heard learned counsel for the petitioner as well as learned State counsel and gone through the record. As per the FIR, no allegations have been levelled against the Rajesh Kumar 2017.01.25 11:21 I attest to the accuracy and authenticity of this document.

CRM-M-45788-2016 present petitioner, who is the sister of deceased Sweety and the daughter of the main accused. As per allegations of the prosecution, it is a honour killing case and Sweety was killed by her parents. The present petitioner is named by the co-accused and was stated to be also present there. However, no role has been attributed to her in the commission of murder. The petitioner has been in custody since 05.07.2016. She is not required for any investigation or interrogation purposes as she is in judicial custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case, especially when no attribution is alleged against her.
Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to her furnishing personal bonds in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
