The present petition has been filed under Section 482 of Bharatiya Nagrik Suraksha Sanhita, 2023 (438 Cr.P.C.) seeking anticipatory bail to the petitioner in FIR No.08 dated 24.01.2025 under Sections 18/61/85 of Narcotic Drugs and Psychotropic Substances Act registered at Police Station City Samana, District Patiala.

Learned counsel for the petitioner submits that 1 kg 500 gm of opium has been recovered from the petitioner. It is further submitted that the petitioner was regularly appearing before the learned trial Court. However, he missed the date on 16.09.2025 as he was misinformed of the date. Consequently, his bail order was cancelled and his bail bonds and surety bonds were forfeited to the State and the petitioner was ordered to be summoned through non-bailable warrants.

I have heard learned counsel for the parties and gone through the case file.

In view of the facts and circumstances of this case, this Court is not inclined to grant anticipatory bail to the petitioner. However, liberty is granted to the petitioner that in case, he surrenders before the trial Court within 07 days and moves an application for grant of bail, the same shall be considered and decided by the trial Court within a period of three days of filing of the said application in accordance with law. 8.
