ARVIND SINGH SANGWAN, J. (Oral) CRM No.288 of 2018 Prayer in this application is for addition of Section 326 IPC in the captiion and prayer clause of the main petition. Heard.

Allowed as prayed for.

MAIN CASE The petitioners pray for grant of anticipatory bail in FIR No.100 dated 26.09.2017 registered under Sections 452, 324, 148 and 149 IPC at Police Station Arniwala, District Fazilka. Counsel for the petitioners submits that in pursuance to the order dated 28.11.2017, the petitioners have already appeared before the Investigating Officer and joined the investigation. Counsel for the State, on instructions from ASI Kartar Singh, has not disputed the factual position and states that the petitioners are not required for any further investigation. On the other hand, counsel for the complainant has opposed the prayer for bail on the ground that Section 326 IPC has been added.

CRM No.M-44919 of 2017 (O&M) No.7 which is stated to be grievous injury is on the non-vital part i.e. right little finger of the injured, the present petition is allowed and the interim bail granted to the petitioners vide order dated 28.11.2017 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
