The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.103 dated 5.6.2020 at Police Station Dhand, District Kaithal under Section 24 of Immigration Act and Sections 406 and 420 of Indian Penal Code, 1860.

On the last date of hearing i.e. on 13.8.2020 this Court, while issuing notice of motion, had passed the following order:

( 2 ) CRM-M-22247-2020 (O&M) "The learned counsel for the petitioner submits that pursuant to withdrawal of the first petition for grant of anticipatory bail, there has been change of circumstances inasmuch as the parties have amicably resolved their issues and have entered into a compromise. Notice of motion for 1.12.2020.

At this stage, Mr. Pardeep Chhoker, Advocate has put in appearance on behalf of the complainant and also accepts notice on behalf of the complainant. He has endorsed the fact that the parties have indeed entered into a compromise. Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438(2) Cr.P.C."

The learned State counsel upon instructions from SI Dharmpal has informed that pursuant to interim directions issued by this Court, the petitioner has since joined investigation and that he is not required for any custodial interrogation.

Having regard to the fact that the matter is stated to have been compromised and that the petitioner has since joined investigation, the petition is accepted and the interim directions issued by this Court vide order dated 13.8.2020 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
