Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.632 dated 06.11.2017 under Sections 186, 225, 332, 342, 353 and 34 IPC, registered at Police Station City Palwal, District Palwal.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per the FIR, Sumer is the main accused, who was apprehended by the police and as per allegations, he was Vineet Gulati 2017.12.08 14:21 I attest to the accuracy and authenticity of this document Chandigarh got free from the police station by the family members. Present petitioners
CRM No.M-44943 of 2017 -2are father and mother of Sumer.
Learned counsel for the petitioners contends that the FIR was also got registered against the police by the petitioner side on the same day and to save themselves, the police registered this false FIR. From the perusal of the record, I find that the petitioners are not required for custodial interrogation. Nothing is to be recovered from them. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where petitioners are entitled to benefit of anticipatory bail. Therefore, present petition is allowed. It is ordered that in the event of arrest, the petitioners be released on bail subject to their furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer.
