The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.281 dated 31.7.2018 registered for the offence under Section 406 IPC at Police Station Badhra, District Charkhi Dadri.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that the FIR in the present case has been registered by the complainant Vikram, who stated that he was away from the house and the accused-petitioner came to his house in his absence and after telling lie to the wife of the complainant took way buffalo by playing fraud. A perusal of the record shows that the buffalo is still to be recovered. Hence, the petitioner is required for custodial interrogation. Cr. Misc. No.M-45905 of 2018 [2] Keeping in view the facts and circumstances of the present case and the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail.

Therefore, finding no merit in this petition, the same is dismissed.
