**** RITU BAHRI, J. (Oral) Present petition is for release of petitioner on regular bail in FIR No.69 dated 24.09.2016, under Sections 506/34 IPC; Section 6 of POCSO Act and Section 3 of SC/ST Act, registered at Police Station Women, District Jind.

Learned counsel for the petitioner submits that as per the statement made under Section 164 Cr.P.C. by the prosecutrix, the allegation of rape has not been attributed to the present petitioner. Learned State counsel, on instructions from investigating officer, has informed that there are total 17 witnesses in the instant case and now the trial is fixed for 17.05.2017 for recording the evidence of the prosecutrix.

I have heard the learned counsel for the parties and with their Naresh Kumar 2017.04.27 16:41 I attest to the accuracy and integrity of this document Chandigarh able assistance gone through the material available on record.

CRM-M-45867-2016 -2The petitioner was arrested on 25.09.2016. Since then, he is in judicial custody and no useful purpose would be served to further detain him in jail. The final conclusion of trial will take a long time. In view of above facts, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Jind.

Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
