Petitioner has filed this second petition under Section 438 read with Section 482 Cr.P.C. for grant of anticipatory bail in case FIR No.130 dated 11.02.2017 under Sections 120-B, 420, 467, 468, 471 IPC, Sections 13, 7 and 8 of the Prevention of Corruption Act and Section 25 of the Arms Act, registered at Police Station Civil Lines, District Gurgaon (Gurugram). Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that present petitioner was already on regular bail but he absented from the Court proceedings on 04.10.2018 and VINEET GULATI 2018.10.30 15:09 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-45936 of 2018 -2non-bailable warrants have been issued against him. No useful purpose will be served by sending the petitioner to custody. However, as the petitioner earlier on three occasions had filed application for personal exemption and now absented from the Court proceedings and had delayed the trial of the case, therefore, the present petition is accepted, subject to the condition that petitioner will deposit `10,000/- as costs with the concerned District Legal Services Authorities and surrender before the trial court within 10 days from today and if he fails to comply with the above conditions, then this petition shall be treated as dismissed.
