******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 09 dated 19.03.2013, registered for offences punishable under Sections 307, 120-B read with Section 34 of Indian Penal Code (for short 'IPC'), 21 of NDPS Act and 25 of the Arms Act, at Police Station Khem Karan, District Tarn Taran.
Heard.
Learned counsel for the petitioner submits that the petitioner has already surrendered before the trial Court and has been allowed bail under order dated 21.09.2016. He further submits that the petitioner had been regularly appearing before the trial Court but on 08.12.2016, he could not appear due to his ill health. There is no other instance of his absence in this case.
Keeping in view the fact that the petitioner has surrendered before the trial Court and had earlier been regularly appearing during trial, Jitender Kumar 2017.01.25 16:16 I attest to the accuracy and integrity of this document
CRM-M-45887 of 2016 -2this petition is allowed and order dated 21.12.2016 is made absolute on his furnishing undertaking before trial Court that he will keep on appearing before the trial Court and comply with the other terms of bail as contained in Section 437(3) Cr.P.C.
