KARAMJIT SINGH , J. (Oral) Case has been heard through Video Conferencing in view of COVID-19 Pandemic.

In the present writ petition, the grievance of the petitioner is that though he retired from the service on 30.04.2012 but his retiral benefits were released belatedly and he is entitled to get interest on the said belated payments. In this context, learned counsel for the petitioner has relied upon the decision of the Coordinate Bench of this Court passed in CWP No.15322 of 2019 decided on 30.05.2019 (Annexure P-2). Learned counsel for the petitioner further prayed that this writ petition be disposed of on same lines as the petitioner had already issued legal notice (Annexure P-1) dated 20.11.2019 to the concerned authorities. However, no action has been taken on the said notice by the respondents.

Notice of motion.

At this stage, Mr. Sukhbeer Singh, Assistant Advocate General, Punjab, accepts notice on behalf of the State and submitted that the needful would be done only by respondent Nos.4 and 5. He has no objection if the writ VIRENDRA SINGH ADHIKARI 2020.08.11 11:21

CWP-11550-2020 -2petition is disposed of on the same lines as per the decision in CWP No.15322 of 2019 passed by the Coordinate Bench of this Court. Accordingly, this writ petition is hereby disposed of, without commenting on the merits of the case or expressing any opinion to the entitlement of the petitioner in respect of claim in the present writ petition or in the legal notice, with a direction to respondent Nos.4 and 5 to pass a speaking order on the claim of the petitioner in the legal notice (Annexure P-1) dated 20.11.2019, in accordance with law and in light of Annexure P-2, within a period of three months from the date of receipt of the certified copy of this order. In case, after the order, it is found by the aforesaid respondents that the petitioner is entitled to get any such interest, the same should also be released to him within a period of next three months.
