**** RITU BAHRI, J. (Oral) This petition under Section 482 of the Code of Criminal Procedure is for issuance of direction to respondent Nos.2 and 3 to submit the report to respondent Nos.1 and 4 for re-issue the passport of the petitioner.

Learned counsel for the petitioner submits that after registration of FIR (Annexure P-1), the petitioner got anticipatory bail , vide order dated 21.04.2014 (Annexure P-3). Petitioner and his wife in the month of December 2014, have filed an application before the Court of District & Sessions Judge, Gurgaon, for seeking permission to travel abroad and the same has been granted to them, vide order dated 09.12.2014 (Annexure P-4) as they have been found innocent during the investigation. The petitioner has applied for re-issuance of his passport on 09.09.2015 as the same is Naresh Kumar 2017.02.16 16:43 I attest to the accuracy and integrity of this document Chandigarh going to expire on 17.06.2017 and similar application has been made by his

CRM-M-4505-2017 -2wife on 19.06.2015. Passport of wife of petitioner has since been received whereas the passport of the petitioner has not been received despite filing of representations dated 16.11.2016 and 13.12.2016 (Annexure P-8) to the respondents for re-issuance of his passport.

Notice of motion be issued to the respondents. At this stage, Ms. Mahima Yashpal, AAG, Haryana, accepts notice on behalf of respondent Nos.2 and 3.

In view of above, without commenting on the merits of the case, this petition is disposed of with a direction to respondent Nos.2 and 3, to pass appropriate orders on the representations (Annexure P-8), filed by the petitioner, within a period of six weeks, from the date of receipt of certified copy of this order.
