M.M.S. BEDI, J (ORAL) Counsel for the petitioner submits that petitioners being relations of the husband of complainant Bhawna have been falsely implicated.
A perusal of the FIR indicates that there are allegations of demand of dowry and cruelty against the petitioners. A copy of entire report under Section 173 (2) Cr.P.C., is not made available with this Court to appreciate the material which has been gathered during the course of investigation to substantiate the allegations.
Counsel for the petitioners informs that the charges have not yet been framed.
In view of peculiar circumstances of the case, this petition is dismissed as pre-mature, at this stage, with liberty to the petitioners to raise all the pleas before the trial Court at the time of RAJ KUMAR ARORA 2015.02.13 17:18 I attest to the accuracy and integrity of this document

It is ordered that in case on the basis of the material forming part of the report under Section 173 (2) Cr.P.C., no offence is found to be made out on the basis of uncontroverted allegations, it will be open to the trial Court to discharge the petitioners or any of the petitioners. It is expected that all the pleas raised before the trial Court will be considered at the time of consideration of charges.
