Present writ petition has been filed for directing respondent No.1 to conduct enquiry against respondent No.5 and remove him from the post of member, Zila Parishad, Kaithal under Section 160 of Haryana Panchayati Raj Act, 1994.

The only apprehension projected by learned counsel for the petitioner in the present petition is that respondent No.5, who was Member, Zila Parishad was implicated in FIR No.3, dated 18.01.2024 under Sections 120-B, 384 of IPC and Sections 7, 7-A of the PC Act and was suspended vide order dated 07.03.2024. He submits that now the respondent authorities are in the process of revoking his suspension without following the due process.

On asking of the Court, Ms. Upasna Dhawan, AAG, Haryana appears and accepts notice on behalf of the respondents-State. She, on instructions from Ms. Yashwani Pannu, Superintendent, has refuted the allegations made by the petitioner. She has submitted that record regarding the antecedents of respondent No.5 has been called for and further action would be taken only in accordance with law. 5.
In view of the above position, the present petition is disposed of with direction to respondent No.1 i.e. Commissioner-cumSecretary, Department of Development & Panchayat, Haryana to proceed with the case in accordance with law.
