Learned counsel submits that the petitioner remained the Director of the Sarv Agro India Ltd. only for 18 days from November, 2013 to December, 2013, whereafter he resigned for which reference is made to record of ROC dated 15.01.2026, Annexure P2. No allurement was made by him to any person for investing in the company which was dealing with mushroom farming. There is no agreement with regard to the same also that has surfaced. He was declared as proclaimed offender, the order of which was set aside by this Court on 22.12.2025, thereafter, he filed an anticipatory bail application before the trial Court which was dismissed, however, in another FIR No.217 of 2019 registered along with the present case with same allegations, he has been granted anticipatory bail by Hon'ble the Supreme Court vide order dated 18.07.2025 by observing that his custodial interrogation not required. He is involved in one more case of similar nature, wherein he is on regular bail. He is ready and willing to join the investigation as and when required by the investigating agency and will cooperate.

CRM-M-19641-2026 (O&M) -2Meanwhile, the petitioner is directed to join the investigation on or before 16.04.2026. In the event of his arrest, he shall be released on interim bail to the satisfaction of the Arresting Officer, subject to compliance of conditions as enshrined under Section 482(2) BNSS.

However, it is clarified that if the petitioner does not join and cooperate with the Investigating Agency as required by the Arresting/Investigating Officer, this interim order shall be deemed to have been vacated.
