The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.20 dated 14.2.2017 registered for the offences under Sections 307 and 34 IPC at Police Station Sadar Jalalabad, District Fazilka.
Notice of motion has been issued in this case. Ms. Monika Jalota, learned Deputy Advocate General, Punjab has appeared on behalf of the respondent-State and Mr. M.S. Cr. Misc. No.M-46017 of 2018 [2] I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. The FIR in the present case has been registered on the statement of Malkit Singh. The present petitioner is named in the FIR. There is allegation that one Kulwant Kaur was having illicit relations with one Jaswant Singh due to which the complainant's brother Darshan Singh used to prevent her from doing this thing. Darshan Singh was found lying in an injured condition near the bridge of drain and his motorcycle was also lying there. There was deep injury on his head. The learned State counsel as well as learned counsel for the complainant brought it to my notice that the injured is still in coma. Serious allegations have been levelled against the present petitioner.
Keeping in view the facts and circumstances of the present case, nature and gravity of the offences and the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
