Prayer made in the present petition is for directing the respondents to promote the petitioner to the post of Hindi Master in the physically challenged (Blind) category against the 3% reservation under the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 and the Right of Persons with Disabilities Act, 2016 from the date the vacancy of the said category became available.

Learned counsel submits that in the speaking order, the aforesaid aspect though had been raised in the representation as also in the previous writ petition bearing CWP-20310-2019, titled as Naresh Pal Vs. State of Punjab and Others, decided on 25.07.2019, has not been referred to much less considered and thus the decision rendered therein.

The aforesaid facts having been brought out, during the course of hearing, learned State counsel on instructions, states that the respondents would not be averse to having a relook at the matter and decide afresh, within a period of AMANDEEP GOSAIN 2025.02.06 23:00 I attest to the accuracy and integrity of this order/judgment

6 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. 4.

The aforesaid satisfies the learned counsel for the petitioner. 5.

The matters stand disposed of accordingly and if the petitioner is found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same may be passed after granting opportunity of hearing to him and shall contain reasons, whereupon he shall be free to seek legal redress thereupon.
