Notice of motion has been issued. Learned State counsel has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner as well as learned State counsel and gone through the record. Perusal of FIR shows that 22 injections of Buprenorphine and 24 boxes of vials of COXVIL were recovered. Recovery of 22 injections of PARVEEN KUMAR 2019.07.03 18:14 I attest to the accuracy and integrity of this document
CRM-M-21429-2019 Buprenorphine falls in commercial quantity. Section 37 of the NDPS Act, 1985 bars the grant of bail to the accused in case of commercial quantity. In view of the above, I do not find it a fit case where the petitioner is entitled to the benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
