Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.8 dated 03.01.2015 under Sections 420, 384 and 170 IPC registered at Police Station Jagadhri City, District Yamuna Nagar.
I have heard learned counsel for the petitioner and have gone through the record.
The FIR in the present case has been got registered by Sunil Aggarwal mainly on the allegations that on 03.01.2015 at about 3.00 P.M., when he was at his home for lunch, then his clerk informed him that a team from Pollution Control Department wanted to talk to him and the person, so wanted to talk, introduced himself as B.M.Goyal from Central Pollution Board, Dehli. On this, complainant along with his brother Sachin went to his factory. At the main gate, one car was lying parked with red light. CRM No.M-5036 of 2015 -2two officials Ajay Kumar and Vinod Sharma, demanded `15 lacs and as per prosecution version, they were the members of a fake team. The present petitioner B.M.Goyal ran away from the spot whereas Ajay Kumar and Vinod Sharma were apprehended on the spot and handed over to the police.
Keeping in view the facts and circumstances of the present case, nature and gravity of the offence and the fact that petitioner is required for custodial interrogation, I do not find it a fit case where petitioner is entitled to benefit of grant of anticipatory bail. Therefore, finding no merit in the present petition, the same is dismissed.
