   This petition has been filed for issuance of writ in the nature of Habeas Corpus and for appointment of Warrant Officer for release of the detenue namely Nija, aged about 18 years-wife of the petitioner from illegal custody of private respondents No.4 to 10.

This Court after hearing learned counsel for the petitioner on 06.05.2024 directed the State to file the status report with a direction to produce the alleged detenue in Court.

In compliance thereto, status report by way of affidavit of Surendra Lamba, IPS, Senior Superintendent of Police, Hoshiapur, District Hoshiarpur has been filed in Court, which is taken on record. The alleged detenue, namely, Nija, has been produced in Court and is accompanied by ASI Amit Kumar. On asking of the Court, she blatantly refused to join the company of the petitioner and rather prefers to DINESH BANSAL 2024.05.14 18:50 I attest to the accuracy and integrity of this document Chandigarh

    stay with her parents. Learned State counsel has informed the Court that the husband is involved in filing of multiple frivolous and malicious petitions including one for seeking protection on account of performing the marriage and has also lodged FIR No.78 dated 11.04.2024 against the family member of the alleged detenue Nija.

From the perusal of the said status report, it reveals that Nija is living with her family members with her own free will and without any pressure or coercion.

In view of the aforesaid stand of the alleged detenue Nija, learned counsel for the petitioners prays to withdraw the present petition. Prayer is accepted.

Dismissed as withdrawn.
