*** The matter has been compromised between the parties in terms of which the petitioner and complainant have filed a petition for divorce by mutual consent. Statements of the parties at first motion have been recorded on 28.9.2018 and next date of hearing is fixed as 3.4.2019. A sum of Rs.6,50,000/- is said to have been paid by petitioner Nishant to his wife Anamika, who is complainant in this case.

Learned State counsel submits that in view of the compromise between the parties the custodial interrogation of the petitioner is not required. Under such circumstances, the interim bail granted to the petitioner on 23.12.2016 is made absolute, subject to his fulfilling conditions under Section 438(2) Cr.P.C.

The petition stands allowed accordingly.
