The petitioner seeks the concession of regular bail in a case registered on the basis of a secret information to the effect that he along with his father was carrying poppy husk in a Maruti car. When intercepted at a naka, father of the petitioner was arrested while the petitioner allegedly escaped from the spot. The name of the petitioner was allegedly disclosed by his father, arrested from the spot. The recovery was effected on 16.12.2012. The petitioner has been in custody since 16.9.2014. Since the petitioner was not arrested from the spot and is not involved in any other case, his conscious possession of the contraband will certainly be a debatable issue during trial.

Without expression of any opinion on merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court.
