Instant petition has been filed under Section 438 Cr.PC for grant of anticipatory bail to the petitioner in case FIR No.195 dated 29.04.2023 under Sections 420, 465, 467, 468 and 471 IPC at Police Station Civil Lines, Hisar District Hisar.

Learned counsel for the petitioner inter alia contends that the petitioner himself is a victim of a fraud, played by one Mittal Emigration Institute, Ganganagar, Block H, Rajasthan, which had assured him that their institute was affiliated with one Janardhan Rai Nagar Rajasthan Vidhiyapith (Deemed University). On the assurance given, the petitioner had then paid fees in the sum of Rs.60,000/- for three years and got admitted in the said institute. Thereafter, the petitioner appeared in Bachelor of Arts examination and finally passed out in the year 2016. Learned counsel has drawn the attention of this Court to Annexure P-1, which is a copy of the Detailed Marks Certificate issued by Janardhan Rai Nagar Rajasthan Vidhiyapith. CRM-M-23545-2023 -22023:PHHC:067216 on the basis of said certificates/degree issued by Janardhan Rai Nagar Rajasthan Vidhiyapith, the petitioner had got admission in Masters of Arts in Bikaner University.

Heard learned counsel for the petitioner and perused the relevant material available on record including the allegations levelled in the FIR, which was registered at the instance of ASI Manju.

As per the allegations levelled in the FIR, the petitioner managed to procure a government job in the Police Department on the basis of a fake degree. Subsequently, when his BA certificates/degree was sent for verification to the Janardhan Rai Nagar Rajasthan Vidhiyapith, a report was received that the certificate/degree had not been issued by it. 5.

Prima facie, there are serious allegations against the petitioner of having got a job in the Police Department on the basis of fake certificate/degree. His custodial interrogation would, thus, definitely be required to go to the root of the origin from where and through whom he managed to manipulate such false degree.
