On 10.10.2022, the matter was adjourned sine die because petitioner on every occasion was seeking adjournment. The matter was pending at in limine stage for more than one year. 2.

From the perusal of record, it is evident that petitioner was dismissed from service because he submitted forged birth certificate. An FIR was registered against him. He was convicted by Trial Court and Appellate Court dismissed his appeal. This Court reduced his sentence to already undergone. It means the petitioner was not acquitted and it was established even in the criminal proceedings that he had submitted forged date of birth certificate.

In such circumstances, there is no question to interfere with the impugned orders whereby departmental authorities have dismissed the petitioner from service.
