The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking:

a. Direction to respondents not to encroach upon his private land and install proposed 22KV power grid at village Mubarikpur, Dera Bassi, District SAS Nagar (Mohali); b. Restrain the respondents from interfering in peaceful possession of the land;

c. Direction to respondents to remove all transformers, poles, grid infrastructure and other electricity installations;

-2d. Direction to respondents to compensate him for infrastructure installed on his land without his consent and compensation;

e. Setting aside of communication authorizing installation of 22KV power grid; and f. Direction to respondents from entering upon the land and installing electricity infrastructure.

The petitioner is a resident of Chandigarh and owner of subjected land. He is running a brick kiln business on the subjected land under the name and style of Kuldeep Singh & Bros. A 66KV electricity grid already exists adjacent to his land. The respondents without initiating land acquisition process, survey, issuing notice, obtaining his consent or paying compensation have installed grid infrastructure on the subjected land. The official respondents on 06.04.2026 trespassed over his land without authorization. The proposed 22KV power grid is in proximity to human habitation and poses a risk to the health and safety of the inhabitants. The proposed power grid will render the land unusable for his brick kiln business.

Learned Senior Counsel for the respondent-PSTCL, on instructions from Mr. Manpreet Singh Sr. XEN, TLSC Division Mohali, submits that Corporation would calculate compensation as per notification dated 03.02.2025 and pay to the petitioner within two weeks from today subject to petitioner providing his bank account details. If petitioner feels aggrieved, he can challenge amount of compensation.

In the wake of statement of learned Senior Counsel for respondent-PSTCL, the petition stands disposed of. The petitioner is at liberty to avail remedies as permissible by law qua amount of compensation and notification dated 03.02.2025, if he feels aggrieved. Learned counsel for petitioner is directed to intimate bank account details of petitioner to Mr. Abhishek Sharma, Advocate within 24 hours. 5.
