KARAMJIT SINGH , J. (Oral) The case has been taken up through Video Conferencing due to prevailing situation of COVID-19.
This petition has been filed by the petitioners under Article 226/227 of the Constitution of India seeking protection from private respondent Nos.4 and 5 on the ground that they got married on 05.08.2020 against the wishes of the parents of petitioner No.1-Baljeet Kaur. Both the petitioners are major, as has been stated in the petition. The petitioners have already move an application dated 06.08.2020 (Annexure P-5) to respondent No.2, i.e., Senior Superintendent of Police, Taran Tarn for providing protection to their life and liberty.
Learned State counsel submitted that petitioners are not residing at the given address. However, the learned State counsel is not averse if direction is given to respondent No.2 to dispose of the application dated 06.08.2020 VIRENDRA SINGH ADHIKARI 2020.08.14 14:18
CRWP No.5822 of 2020 -2- (Annexure P-5), in accordance with law.
In the light of the aforesaid, this Criminal Writ Petition is hereby disposed of with a direction to respondent No.2 to look into the matter and decide application dated 06.08.2020 (Annexure P-5) moved by the petitioners, in accordance with law, by passing a speaking order within next 10 days and if necessary, to provide proper security to the petitioners and in the meantime, to protect their life and liberty from respondent Nos.4 and 5. Nothing expressed herein-above would be construed as an expression of any opinion with regard to the validity of the marriage of the petitioners.
