**** RAJ MOHAN SINGH, J.(Oral) Notice of motion was issued subject to payment of Rs.25,000/- as litigation expenses to be remitted to the respondent by way of demand draft. Thereafter liberty was given to the appellant vide order dated 25.11.2019 to remit the aforesaid amount of Rs.25,000/- towards interim litigation expenses to the respondent-wife by way of demand draft through registered post. Thereafter the case was referred to the Mediation and Conciliation Centre of this Court when learned counsel for the respondent made his appearance. Mediation proceedings could not fructify as the appellant never appeared before the Mediation and Conciliation Centre of this Court. That is how the case is referred back to MOHMED ATIK 2023.10.07 20.08 I attest to the authenticity and integrity of this order/judgment

Today, learned counsel appearing on behalf of the appellant pleads no instruction. Factum of payment of Rs.25,000/- towards litigation expenses has been denied by learned counsel for the respondent.

In view of aforesaid position, this Court is left with no alternative but to dismiss this appeal for non-prosecution. Dismissed for non-prosecution.
