Rakesh Singla v. State Of Punjab
IN THE HIGH COURT OF PUNJAB & HARYANA
AT CHANDIGARH CWP-1399-2004 Date of decision: 08.04.2025 Rakesh Singla
...Petitioner
Versus
State of Punjab
...Respondent
CORAM: HON'BLE MR. JUSTICE AMAN CHAUDHARY ***** Present :
None for the petitioner.
Mr. Manipal Singh Atwal, DAG, Punjab.
***** AMAN CHAUDHARY, J. (Oral) 1.
Prayer made in the present petition for directing the respondent to fill up the post of Deputy Director, Ayurveda on regular basis from the teaching cadre, might not, due to efflux of time, even be surviving. 2.
Learned State counsel refers to preliminary objections Nos.1, 2 and 6 of the written statement to state that the said post was an ex-cadre post and not included in the Ayurvedic Class I & II Rules, 1963. It was to be filled up by way of promotion on the basis of seniority-cum-merit. Mere fulfilment of qualifications and experience did not entitle the petitioner to be posted against the said post leaving behind the senior faculty members and he is working as a Reader on purely temporary and stopgap arrangement basis against a Class III, ex-cadre and direct recruitment quota. 3.
Disposed of, reserving the petitioner with a liberty to get it revived, in case lis still subsists.
