Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.147 dated 22.09.2018 under Section 22 of the NDPS Act, registered at Police Station Fatehgarh Sahib. Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. The perusal of the record, shows that FIR in the present case has been registered on the basis of secret information against Parminder Singh alias Dola and Tejinder Singh alias Teji that both of them used to sell huge quantity of intoxicant tablets and on that day also, selling the same to VINEET GULATI 2018.11.30 16:33 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-46169 of 2018 -2the passengers/drug addicts. When the raid was conducted, co-accused Parminder Singh was apprehended with 17500 intoxicant tablets and he made disclosure regarding the source of those tablets i.e. present petitioner. The recovery in the present case fall under commercial quantity. Keeping in view the facts and circumstances of the present case, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail. Otherwise also, Section 37 of the NDPS Act bars the grant of bail to the accused in the case of commercial quantity. Therefore, finding no merit in the present petition, the same is dismissed.
