(ORAL) Through this petition under Section 482 Cr.P.C., prayer has been made for transfer of investigation in case FIR No. 213 dated 16.06.2018 (Annexure P-1) registered under Section 302 read with Section 34 IPC at Police Station Nissing, District Karnal, Haryana, to respondent No. 4-Central Bureau of Investigation, as the police is not properly investigating the matter and without filing final report under Section 173(2) Cr.P.C., discharged respondents No. 5 to 7, on the basis of statements of villagers, who are none else, but the relatives or family members of accused-respondents No. 6 and 7, namely; Bhim Singh and Chintu @ Sukhdev.

CRM-M-46171-2018 -2Deputy Superintendent of Police, Assandh, learned counsel for the petitioner contends that purpose of the instant petition would be achieved and he would be satisfied, in case, investigation in the aforesaid FIR is handed over to crime branch or to an IPS Officer. Heard.

In the fitness of things and considering the allegations of the petitioner against the present Investigating Officers, investigation in case FIR No. 213 dated 16.06.2018 (Annexure P-1) is ordered to be transferred to Sh. Surender Pal, Superintendent of Police, Kurukshetra, who would do the needful and complete the investigation preferably within three months from the date of receipt of copy of this order. The instant petition stands disposed of, accordingly.
