Ramendra Jain, J (Oral) Through this 2nd petition under Section 439 Cr.P.C., petitioner - Sabana has prayed for grant of regular bail in case FIR No.02 dated 03.01.2018 under Sections 302, 34, 120-B IPC and 25 of Arms Act, registered at Police Station, Balongi, District SAS Nagar. Learned counsel for the petitioner contends that petitioner is facing trial in a murder case vide the aforesaid FIR on the allegations that in the morning of 03.01.2018, she committed the murder of her husband with the aid of her co-accused namely Mod. Gulzar and Shabnam. Learned counsel contends that all the material witnesses including alleged recovery witness have turned hostile. On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering the overall facts and circumstances, but without expressing any opinion on the merits of the case, petition is allowed. Consequently, petitioner - Sabana is ordered to be released on bail pending trial on her furnishing adequate bail and surety bonds to the satisfaction of trial Court/ Duty Magistrate concerned.
