Challenge in the present appeal is to the judgment/order dated 06/08.11.2004, passed by the learned Judge, Special Court, Kurukshetra, whereby appellant was convicted and sentenced as under: Offence u/s Imprisonment Fine Default sentence 18 NDPS Act RI for six years Rs.30,000/- RI for six months 2.
Learned counsel for the appellant has produced a copy of the registered letter, which is taken on record as Mark A, wherein as per the report of the postal authorities, the sole appellant has since passed away. 3.
Learned State counsel on instructions confirms the aforesaid fact. 4.
