Counsel has inter alia argued that challan has not been presented. He has further submitted that the Public Prosecutor has given an opinion that no offence is made out against the petitioners. Since the challan has not yet been presented, the present petition is not maintainable.

Disposed of as not maintainable, without prejudice to the right of the petitioners to approach this court again in case the prosecution agency opts to present challan.
