Present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for issuance of directions to respondent No.2 to transfer investigation of FIR No.361 dated 23.07.2025 registered under Sections 118(2), 118(1), 333, 115(2), 324(4), 191(3) and 190 of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS') at Police Station Goindwal Sahib, District Tarn Taran and General Diary No.42 dated 25.07.2025 registered under Sections 117(1), 115(2), 118(2) and 3(5) of BNS arising out of FIR No.361 dated 23.07.2025 pending before respondent Nos.3 and 4 to some other district in Punjab or to any other police officer not below the rank of Deputy Superintendent of Police.

Learned counsel for the petitioner contended that in the present matter, FIR and GDR were registered 09 months ago, but the accused persons are roaming freely and have not been arrested till date. As such, learned MANISHA 2026.04.18 14:37 I attest to the accuracy and integrity of this document

CRM-M-20534-2026 counsel prayed that the investigation of the present FIR and GDR be transferred to any other district for fair and proper investigation. 3.

Notice of motion.

Mr. Anup Singh, AAG, Punjab, present in the Court, accepted notice on behalf of respondent-State and submitted that in the FIR, out of total 05 accused persons, 02 accused have been arrested and are joined in the investigation, and 03 accused are at large and their arrest warrants have also been issued; in DDR, out of total 04 accused persons, 03 accused are joined in the investigation and 01 accused is at large and efforts are being made to arrest the remaining accused persons. He further submitted that final report qua apprehended accused has already been presented in the FIR and GDR, who have been forwarded to the Illaqa Magistrate. 5.

Keeping in view the submissions made by learned counsel for the petitioner that investigation is pending for about 09 months and the response given by learned State counsel, the present petition is disposed of with a direction to respondent No.3-Senior Superintendent of Police, District Tarn Taran, Punjab to look into the representation dated 06.04.2026 moved by the petitioner and investigation of the FIR and GDR be also supervised by the officers not below the rank of Deputy Superintendent of Police to conclude the investigation expeditiously.
