(Oral) This is a petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 for issuance of direction to the learned Judicial Magistrate Ist Class, Karnal to consider complaint No. COMI 36 of 2024 instituted on 20.1.2024 which is pending before the said Court.




      

 
he is aggrieved by the pendency of the aforesaid complaint (Annexure P-1). He further contends that the statement of the petitioner was recorded on 17.08.2024 as CW-4 and thereafter, the case was adjourned for arguments on point of summoning of accused. It is further contended that the matter has since been adjourned number of times for about 09 dates and no order has been passed yet on the said point. It is also stated that the petitioner has been present for arguments, however, the case was adjourned on various dates (Annexures P-3 to P-7). 3.

In view of the given facts and circumstances of the present case, the present petition is disposed of with a direction to the trial Court concerned to decide the matter with regard to summoning of the accused/respondents, within a period of 04 weeks of receipt of copy of this order.
