RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.261 dated 11.06.2004 registered under Sections 406, 420 and 34 IPC pertaining to Police Station Division-8, and all consequential proceedings arising therefrom, on the basis of compromise dated 16.10.2013 (Annexure P-2) arrived at between the parties.
Pursuant to order dated 15.12.2018 of this Court, the parties appeared before the trial Court on 15.01.2019 to get their statements recorded. Learned Judicial Magistrate Ist Class, Jalandhar, has submitted her report vide letter bearing No.52 dated 21.01.2019 duly forwarded by learned District and Sessions Judge, Jalandhar, vide letter No.220G/JRK dated 22.01.2019. According to the report of learned Judicial Magistrate Ist RAVINDER SINGH 2019.02.05 13:59 I attest to the accuracy and authenticity of this document Class, Jalandhar, petitioner has deposited the amount of `15,000/- in
-2CRM-M-46226 of 2018 the relevant heads as directed by this Court vide order dated 15.12.2018. Learned Magistrate is satisfied that compromise arrived at between the parties is genuine, voluntary and without any coercion or undue influence. Accused Surjit Kaur alias Sitto is still proclaimed offender in this case.
Considering the report of learned Judicial Magistrate Ist Class, Jalandhar, dated 21.01.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.261 dated 11.06.2004 and all subsequent proceedings arising therefrom, are quashed qua petitioner only. Disposed of accordingly.
