(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No.430, dated 06.11.2014, registered at Police Station Shahabad, Kurukshetra, Distt. Kurukshetra, who has been booked for having committed the offence punishable under Sections 34/120-B/365/392 IPC. The accused robbed the truck of the complainant in which 497 bags weighing 50 kgs each of Basmati paddi, one mobile phone and cash amount of Rs.3,000/- were lying. As per the allegations in the F.I.R, the petitioner was not named in the F.I.R and he was not arrested on the spot. He was arrested on the disclosure statement made by one Ram Kishan. The role attributed to the petitioner that he had done the reki. Learned State counsel on instructions from ASI Gurwinder Sngh submits that out of 14 prosecution witnesses, one has been examined and the next date is 19.01.2015 before the trial Court.

Crl. Misc.No. M-516 of 2015 (O&M) -2The petitioner is in custody since 10.11.2014 I have heard the learned counsel for the parties and with their able assistance gone through the material available on record.

Keeping in view the period of incarceration of the petitioner, this court feels that there is no need to detain the petitioners any longer, Accordingly, the present petition is allowed. Petitioners are ordered to be released on bail during pendency of the trial of the present case, subject to their furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Kurukshetra.
