M.M.S. BEDI, J (ORAL) Petitioner is a complainant in a case registered against respondent Nos.5 to 9. The petitioner is not satisfied with the investigation being conducted by the investigating officer. There are certain allegations levelled against the investigating officer of not showing fairness in the investigation. A representation is stated to have been submitted to the Senior Superintendent of Police, Patiala. Instead of issuing a direction for fair investigation or transfer of the investigation, I deem it appropriate that the allegations of the petitioner may be looked into by the Senior Superintendent of Police, Patiala.

Notice of motion to the Advocate General, Punjab. On asking of the Court, notice has been accepted by Mr.C.S.Brar, DAG., Punjab, present in the Court. Copy given. CRM-M-5161-2015 (O&M) Senior Superintendent of Police, Patiala, will look into the matter regarding the fairness of the investigation. In case he is satisfied that the investigation is being conducted fairly in accordance with Punjab Police Rules, and Chapter XII Cr.P.C., it will be open to the Senior Superintendent of Police, Patiala to permit the continuation of investigation but in case any thing is found wanting, it will be open to the Senior Superintendent of Police, Patiala to transfer the investigation to some other officer or to get it supervised under the vigilance of some other senior officer. It will be appreciated in case necessary steps are taken within a period of one month after the receipt of a certified copy of the order.
