Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in complaint case bearing No. COMI/214/2015 dated 16.1.2013, under sections 302 and 120-B IPC, District Pathankot. Learned counsel for the petitioner contended that petitioner has been falsely implicated in the present case, though the dispute is primarily regarding matrimonial. Learned counsel further contended that complainantKanso Devi, who is mother-in-law of the petitioner, has falsely implicated the petitioner in the present case. Infact, Jagir Singh, deceased, who was husband of the present petitioner an alcoholic and there used to be a dispute between the parties and there was litigation as well. Moreso, present case is arising out of the complaint case. So, present petitioner be released on prearrest bail and she is ready to face trial. Having considered the submissions made by learned counsel for the petitioner and the fact that the allegations are serious one and death of Deepak Kumar Bhardwaj 2017.12.08 14:58 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-45307 of 2017 Jagir Singh, husband of the petitioner, had taken place in the matrimonial home and clear malice was on the part of present petitioner to cause death of Jagir Singh. The entire controversy does not make out a case for granting the concession of pre-arrest bail to the petitioner. Hence, present petition, being without any merit, stands dismissed.
