CRM-M-45312-2017 Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 75 dated 18.9.2013, registered under Section(s) 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985 (hereinafter referred to as "the Act") at Police Station Ajitwal, District Moga.
Learned counsel for the petitioner contended that petitioner was allegedly found to be in possession of 10,000 intoxicating tablets of MICROLIT and was remanded to custody and thereafter, during investigation, he was found innocent. Criminal Misc. No. M-45312 of 2017 (O&M) period in this case and on the basis of inquiry report and discharge report submitted against him, he was released from the custody vide order dated 26.2.2014, passed by learned Judge, Special Court, Moga. Thereafter, he was again summoned on an application filed under Section 319 Cr.P.C. by the Court, though he was not required for investigation further. Learned counsel for the petitioner contended that petitioner is ready to surrender before the learned trial Court.
Having considered the submissions made by learned counsel for the petitioner, present petition stands disposed of with direction that in case the petitioner surrenders before the learned trial Court, he shall be released on bail on furnishing of his bail and surety bonds to its satisfaction.
