RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video conferencing due to pandemic Covid-19.
Through this petition under Section 439 Cr.P.C., petitionerSumit @ Mittu, has prayed for grant of regular bail in case FIR No. 12 dated 15.01.2018 registered under Sections 406, 420, 342 and 386 (Section 364-A added later on), Sections 25 and 27 of the Arms Act and Section 13 of the Punjab Travel Profession Regulation Act at Police Station Tanda.
Learned counsel inter alia contends that petitioner was not named in the FIR, nor any role/allegation/conspiracy has been attributed to him. He has falsely been implicated in the instant case. Petitioner is in custody since 13.02.2018. Conclusion of trial may take long time. No useful purpose would be served by detaining him in jail. CRM-M-23191-2020 -2petitioner, namely; Harminder Singh @ Shally and Paras Ram @ Paras, have already been enlarged on bail by this Court vide orders dated 28.05.2020 and 22.05.2020, passed in CRM-M Nos. 8530 and 123732020, respectively (Annexure P-2, Colly.). Thus, treating the case of petitioner on the same parity, he may also be granted regular bail. On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of case, the petition is allowed. Consequently, petitioner-Sumit @ Mittu, is ordered to be released on bail pending trial, if, not required in any other case, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
